Terms of Service

1Agreement to these terms

These Terms of Service (the "Terms") are a legal and binding agreement between Personance Inc. ("Personance," "we," "us," or "our") and you, the user ("you" or "your"). They govern your download, access, and use of the PrankCall.AI mobile application and the prankcall.ai website, together with all related services, features, and content (collectively, the "Service").

By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree with any part of these Terms or the Privacy Policy, do not use the Service and delete the application from your device.

Certain features may be subject to additional terms presented at the time you use them (for example, the recording consent acknowledgment described in Section 6). Those additional terms supplement these Terms and, where they conflict, control for that feature.

2Who can use the service

The Service is intended exclusively for adults. You may use the Service only if:

• you are at least 18 years old and meet the minimum age of majority in your state of residence;
• you are not barred from using the Service under any applicable law;
• your account or access has not previously been suspended or terminated by us for a violation of these Terms.

The Service is not directed to minors, and you may not permit any person under 18 to use the Service. Placing a prank call to a minor is strictly prohibited.

Creating an account is not required to use the Service. However, before your first call is placed, you must verify a working mobile phone number that belongs to you. The verification ties your use of the Service to you personally, and you are responsible for all activity associated with your device and your verified number. Keep your verification details accurate and up to date.

3What the service does

PrankCall.AI is an entertainment service. It uses artificial intelligence to place a prank call, in real time, to a U.S. phone number that you choose and enter. During the call:

• the AI carries on a live, generated conversation with the person you call, following the prank scenario you selected and any details you provided;
• you can listen in live, join the conversation, or end the call at any time;
• every call ends with a reveal: the AI identifies the call as a prank, and the person you called receives a reveal text message the moment the call ends — this safety feature is automatic and cannot be disabled;
• optionally, and only if you enable it and acknowledge the recording conditions (Section 6), the call can be recorded and turned into a short video that you may keep, share privately with friends, or post to the in-app community feed.

Calls are placed through the telephony infrastructure from a phone number controlled by the Service, not from your personal number. Call outcomes depend on factors outside our control, including the recipient's carrier and device; we do not guarantee that any call will connect, be answered, or complete.

The Service is provided for personal, non-commercial entertainment only. Any other use is contrary to these Terms.

4Free tier, subscriptions & payments

The Service includes a free tier with a limited number of prank calls per day. Your free daily allowance refreshes automatically, and additional calls may occasionally be available through optional offers shown in the app. During peak hours, free calls may be subject to a wait.

Paid plans (such as Premium and Unlimited) offer higher daily limits, faster refreshes, and priority placement, as described in the app at the time of purchase. For paid plans:

• prices are shown in U.S. dollars inside the app at checkout and may change with notice;
• subscriptions are billed through Apple (App Store) or Google (Google Play), as applicable, at the time of purchase; we never receive or store your card details;
• subscriptions renew automatically at the end of each period unless you cancel before the renewal date; you can manage or cancel your subscription at any time in your App Store or Google Play account settings;
• refunds are handled according to the applicable app store's policies and as required by law; cancelling stops future renewals but does not refund the current period.

Call allowances have no cash value, are personal to you, cannot be transferred or resold, and may be reset or forfeited if your access is suspended or terminated under Section 14.

5Your responsibility; acceptable use

You agree to use the Service lawfully, respectfully, and in accordance with these Terms and applicable federal, state, and local law. You agree that you will not use the Service, directly or indirectly:

1. to call emergency services (including 911), poison control, crisis or suicide hotlines, hospitals, health centers, police or other government agencies, or any number where a prank could endanger a person or divert emergency resources — including making false reports of emergencies ("swatting");
2. to threaten, harass, intimidate, stalk, frighten, or abuse any person, or to call anyone repeatedly or after being asked to stop;
3. to call any person you know or believe to be under 18;
4. to impersonate government officials, law enforcement, attorneys, medical professionals, financial institutions, emergency services, or any other person or entity in a way that is prohibited by law or likely to cause harm;
5. to defraud, scam, or deceive anyone, or to obtain money, property, or personal information;
6. to call businesses or organizations in order to disrupt their operations, including placing fake orders or tying up phone lines;
7. to transmit or promote hateful, discriminatory, obscene, or sexual content, or content that demeans any person or group;
8. to call a phone number that has been added to our block list, or any person who has asked not to receive calls;
9. to record or share any call without the consent required by law (see Section 6);
10. to circumvent our call limits, safety features, block list, suspensions, or any other protective measure;
11. to copy, modify, reverse engineer, decompile, disassemble, scrape, or create derivative works of the Service or its content, or to build a competing product or service;
12. to place bulk, automated, or unsolicited calls, or to send spam;
13. to introduce malware, interfere with the Service's infrastructure, or disrupt other users' enjoyment of the Service; or
14. to violate any applicable law or regulation — including wiretapping and call-recording laws, harassment and disorderly-conduct laws, the Telephone Consumer Protection Act, and privacy laws — or to violate the rights of any third party.

We design the Service against abuse: daily call limits, per-recipient limits, and an automatic reveal at the end of every call. Where we suspect misuse, we may investigate, suspend or terminate access without notice, preserve relevant records, disclose information to law enforcement or other authorities as required or permitted by law, and report conduct we believe to be unlawful.

6Recordings, consent & sharing

Some calls can be recorded and turned into a video (a "Recording"). Recording is entirely optional: it happens only if you turn it on, and only after you explicitly acknowledge the conditions below through the app's consent gate — which cannot be skipped and is never pre-checked.

Call-recording laws differ from state to state. Some states allow recording with the consent of one party to the call; others require the consent of every party. It is your responsibility to know and follow the laws that apply to your call.

If you join a call and speak, you consent to your own voice being included in the Recording.

Sharing. You may share a Recording privately with friends or post it to the community feed only if you have obtained all consent required by law from every person whose voice appears in it, and only if the Recording complies with these Terms. You are solely responsible for the consequences of sharing. We may remove or restrict any Recording at our discretion, including in response to a report or a legal request.

Recordings are stored encrypted and are handled as described in our Privacy Policy.

7Your privacy and your number

Our collection and use of personal information is described in the Privacy Policy. As a core product promise: the person you prank never sees your phone number. Calls are placed from a number controlled by the Service, and your number is not disclosed to recipients.

That protection covers what the app reveals — not what you reveal. If you join a call and identify yourself, or share personal details during the conversation, you do so at your own discretion and risk.

8User content & the community feed

You may choose to post content to the Service, including Recordings, handles, avatars, and reactions ("User Content"). You retain ownership of your User Content, and by posting it you grant Personance a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and create technical derivatives of it (such as thumbnails and formatted versions) solely to operate, improve, and promote the Service, for as long as the content remains in the Service. You may delete your User Content at any time from your profile.

You represent and warrant that: (a) you own or control all rights to your User Content; (b) your User Content includes the voices or likenesses of other persons only with the consent required by law, consistent with Section 6; and (c) your User Content is lawful and does not violate these Terms or any third party's rights.

We may — but are not obligated to — review, moderate, remove, or restrict User Content at our discretion, including content that is reported by other users through the in-app report tools. We take no responsibility for content posted by users.

We respect the intellectual property of others. If you believe content in the Service infringes your copyright, send a notice to support@prankcall.ai identifying the work, the infringing material, and your contact details. We may terminate the access of repeat infringers.

9Intellectual property; limited license

Personance and its licensors own all right, title, and interest in and to the Service and its content — including the software, prank scenarios, AI voices, artwork, graphics, text, sounds, trademarks, and logos (the "Company Content"), together with all intellectual property rights in them.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the application on a device you own or control, solely for your personal, non-commercial entertainment use.

You may not: copy, modify, distribute, sell, rent, or license the Service or Company Content; create derivative works; frame or mirror the Service; remove or alter any proprietary notices; or use Company Content for training any artificial intelligence or machine learning model without our written permission. All rights not expressly granted are reserved.

If you send us ideas, suggestions, or feedback, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or obligation to you.

10Third-party services

The Service interacts with third parties, including the Apple App Store and Google Play (distribution and payments), telecommunications and SMS providers (call and message delivery), cloud hosting providers, and analytics providers. Your use of those third-party services is also governed by their terms and policies. We are not responsible for the acts or omissions of third parties, and we are not liable for delays or failures caused by carriers, app stores, or payment platforms. PrankCall.AI is not sponsored or endorsed by Apple or Google.

11Disclaimer of warranties

The Service and all Company Content are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, Personance disclaims all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Personance does not warrant that the Service will be uninterrupted, timely, secure, accurate, or error-free; that any call will connect or complete; or that calls will be placed during any particular hours. AI conversations are generated automatically and are inherently unpredictable. You use the Service entirely at your own risk. Some states do not allow the exclusion of implied warranties, so some of the above may not apply to you.

12Limitation of liability

To the maximum extent permitted by applicable law: (a) Personance and its officers, directors, employees, agents, affiliates, and licensors will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any lost profits, revenue, data, or goodwill, arising out of or relating to these Terms or your use of the Service; (b) Personance will not be liable for any damages, claims, losses, or expenses arising out of your use or misuse of the Service, including any call you initiate, any recording you enable, any consent you fail to obtain, or any content you share; and (c) Personance's total aggregate liability for any claim will not exceed the greater of one hundred U.S. dollars (US $100) or the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

These limitations apply regardless of the legal theory asserted and even if Personance was advised of the possibility of such damages. They are a fundamental basis of the bargain between you and Personance. Some states do not allow the limitation or exclusion of liability, so some of the above may not apply to you.

13Indemnification

You agree to indemnify, defend, and hold harmless Personance and its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use or misuse of the Service; (b) any call you initiate or any Recording you enable or share, including your failure to obtain any consent required by law; (c) your User Content; (d) your violation of these Terms; (e) your violation of any law or regulation; or (f) your violation of the rights of any third party, including any recipient of a call you initiate.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, at your expense, in which case you will cooperate fully with us.

14Suspension, termination & blocking

We may suspend, restrict, or terminate your access to all or part of the Service at any time, with or without notice, if you violate these Terms, if required by law, or if we reasonably believe it is necessary to protect the safety, rights, or experience of users, recipients, or Personance, or the integrity of the Service.

You may stop using the Service at any time by deleting the application. If you wish your data to be deleted, contact us as described in the Privacy Policy.

We maintain a block list for people who do not wish to receive prank calls, available at prankcall.ai/block-my-number. Numbers on the block list will not receive calls from the Service, and any attempt to circumvent the block list is a violation of these Terms.

Sections 8–13 and 15–18 survive any suspension or termination.

15Changes to the service or these terms

We are always improving the Service and may add, change, or discontinue features at any time. We may also update these Terms from time to time. When we make material changes, we will indicate it by updating the "Last updated" date above and, where required, by giving you additional notice in the app or on the website before the changes take effect. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms. If you disagree with the changes, stop using the Service.

16Governing law & disputes

These Terms and any dispute or claim arising out of or relating to them or to the Service are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles, except where superseded by mandatory consumer-protection law of your state of residence.

If you have a concern, contact us first at support@prankcall.ai — most issues can be resolved quickly. If a dispute is not resolved within thirty (30) days, either party may bring the claim exclusively in the state or federal courts located in Delaware, and both parties consent to the personal jurisdiction and venue of those courts. To the fullest extent permitted by law, each party waives any right to a jury trial.

The Service is controlled and operated from the United States. If you access the Service from outside the U.S., you do so at your own risk and are responsible for compliance with applicable local laws.

17General provisions

• Entire agreement. These Terms, together with the Privacy Policy and any feature-specific terms, constitute the entire agreement between you and Personance regarding the Service.
• Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remainder of the Terms will remain in full force and effect.
• Assignment. You may not assign these Terms or your rights under them. We may assign these Terms in connection with a merger, acquisition, or sale of assets, or to an affiliate.
• No waiver. Our failure to enforce any right or provision is not a waiver of our right to enforce it later.
• Relationship. Nothing in these Terms creates a partnership, joint venture, or agency relationship between you and Personance.
• Notices. We may provide notices to you by email, in-app message, or posting on the website. You may send us notices as described in Section 18.
• Language. These Terms are written in English (US). Any translation is provided for convenience only; the English version controls.
